1. About Zakazhi
Zakazhi is a salon and service booking platform operated by ESA Technologies, 21-VI May Street No. 7, Shtip, North Macedonia ("Zakazhi", "we", "us", "our").
The Zakazhi iOS application ("App") is a marketplace that connects individual users ("Users") with hair salons, beauty salons, barber shops, spas, and other personal care service providers ("Businesses"). Zakazhi acts solely as an intermediary platform. We are not a provider of salon or personal care services, and we are not a party to any service agreement entered into between a User and a Business.
By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the App.
2. Key Definitions
- App: The Zakazhi iOS application and any related digital services.
- User: Any individual who creates an account and uses the App to discover or book services.
- Business: Any salon, barber shop, spa, or personal care service provider listed on the Zakazhi platform.
- Booking: A confirmed appointment request made by a User for a service offered by a Business.
- Payment Provider: A certified third-party payment service provider (PSP) integrated with the platform to process online payments.
- Content: Text, images, reviews, profiles, and any other material submitted to or displayed on the App.
3. User Accounts
To access the full features of the App, you must register an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your login credentials confidential and not share them with any third party.
- Notify us immediately at zakazhi.support@gmail.com if you suspect unauthorised access to your account.
- Be solely responsible for all activity that occurs under your account.
You must be at least 13 years old to create an account. Users between 13 and 18 years old must have the consent of a parent or legal guardian. By creating an account, you confirm that you meet this age requirement.
We reserve the right to refuse registration or suspend any account at our sole discretion.
You may delete your account at any time through the App settings or by contacting us. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.
4. Booking Terms
4.1 Appointment Requests
When you submit a booking request through the App, you are sending an appointment request to the selected Business. A booking is confirmed only when the Business accepts your request. Zakazhi does not guarantee that any booking request will be accepted.
4.2 Cancellations and No-Shows
Each Business sets its own cancellation and no-show policy, which is displayed on its profile page. Users are responsible for reviewing these policies before making a booking. Zakazhi is not responsible for any fees or penalties imposed by a Business as a result of a late cancellation or no-show.
4.3 Service Quality
Zakazhi does not perform, supervise, or guarantee the quality of any services provided by Businesses. Any dispute regarding a service must be resolved directly with the Business. Zakazhi may, at its discretion, assist in facilitating communication between the parties.
5. Payments
5.1 Online Payment Processing
Online payments may be facilitated through certified payment service providers (PSPs) integrated with the Zakazhi platform. All payment transactions are processed securely by the PSP in accordance with applicable financial regulations and PCI-DSS standards.
Payment card data is entered directly into secure payment pages operated by the payment service provider and is never visible to Zakazhi.
Zakazhi does not store, process, or have access to payment card details such as card numbers, CVV codes, or expiry dates. We receive only a payment status confirmation from the payment provider. Your payment data is governed by the terms and privacy policy of the applicable PSP.
5.2 Pricing and Charges
Service prices are set by individual Businesses and are displayed in the App at the time of booking. Zakazhi is not responsible for pricing errors or changes made by a Business. You will be shown the total amount due before confirming any payment.
5.3 Payment Confirmation
A booking is considered commercially confirmed upon receipt of a successful payment confirmation from the PSP. You will receive a booking confirmation in the App and, where applicable, by email.
5.4 Refunds and Disputes
Refund eligibility is determined by the cancellation policy of the relevant Business. If a refund is approved, it will be processed through the original payment method via the PSP. Zakazhi is not liable for delays in refund processing caused by the PSP or your bank. Payment disputes must be raised directly with the PSP or through the App support channel.
5.5 Third-Party Payment Provider
By making a payment through the App, you acknowledge that you are transacting with the PSP subject to their terms and conditions. Zakazhi is not responsible for payment failures, technical errors, or service interruptions on the part of the PSP.
6. Responsibilities of Users
As a User, you agree to:
- Use the App only for lawful purposes and in accordance with these Terms.
- Provide truthful and accurate information when creating your account and making bookings.
- Honour confirmed appointments or cancel in accordance with the Business's stated policy.
- Treat Business staff with respect and courtesy.
- Submit only honest, accurate, and non-defamatory reviews and content.
- Comply with all applicable local, national, and EU laws when using the App.
You are solely responsible for your interactions with Businesses. Zakazhi is not responsible for the conduct of any Business or for the outcome of any service rendered.
7. Responsibilities of Businesses
Businesses listed on Zakazhi agree to:
- Provide accurate, current, and complete information on their profile, including services, pricing, and availability.
- Respond to booking requests promptly and honour confirmed appointments.
- Communicate any cancellations or changes to Users as early as possible.
- Comply with all applicable laws, including consumer protection, health and safety, and data protection regulations.
- Ensure that services advertised on the platform accurately reflect the services provided.
Zakazhi reserves the right to remove, suspend, or restrict any Business listing that violates these Terms or that we determine, at our discretion, is harmful to Users or the platform.
8. Prohibited Activities
The following are strictly prohibited on the Zakazhi platform:
- Using the App for any unlawful, fraudulent, or deceptive purpose.
- Attempting to gain unauthorised access to the App, our servers, or any connected system.
- Reverse engineering, decompiling, or attempting to extract the source code of the App.
- Impersonating any person or entity, or misrepresenting your affiliation with any party.
- Uploading or transmitting content that is harmful, offensive, defamatory, or illegal.
- Using automated tools, bots, or scripts to interact with the App without prior written consent.
- Reproducing, distributing, or commercially exploiting any part of the App without written permission.
- Interfering with or disrupting the security, integrity, or performance of the App.
9. Intellectual Property
The App and all its contents — including software, text, graphics, logos, icons, images, and their design and arrangement — are the exclusive property of ESA Technologies or its licensors and are protected under North Macedonian and international intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable licence to use the App solely for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, or create derivative works of any part of the App without our express prior written permission.
Any feedback or suggestions you provide regarding the App may be used by us freely, without obligation to compensate you.
10. Disclaimer and Limitation of Liability
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.
Zakazhi is a booking marketplace and does not provide salon or personal care services. We are not responsible for the quality, safety, legality, or availability of services offered by Businesses, nor for the accuracy of Business profiles or pricing information.
To the maximum extent permitted by applicable law, Zakazhi and ESA Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of, or inability to use, the App.
- Any service performed or not performed by a Business found through the App.
- Payment failures, processing errors, or delays caused by a third-party PSP.
- Unauthorised access to or alteration of your data.
- Any third-party content or conduct on the platform.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable North Macedonian law.
11. Account Suspension and Termination
We reserve the right to suspend or terminate your account, temporarily or permanently, without prior notice, if we reasonably believe you have:
- Violated any provision of these Terms.
- Engaged in conduct harmful to other Users, Businesses, or the platform.
- Provided false or misleading information.
- Used the App for any fraudulent or illegal purpose.
You may terminate your account at any time by deleting the App and requesting account deletion via the App settings or by contacting zakazhi.support@gmail.com.
Upon termination, your right to use the App ceases immediately. Sections on Intellectual Property, Limitation of Liability, and Governing Law survive termination.
12. Privacy and Data Protection
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, store, and protect your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable North Macedonian data protection law.
By using the App, you acknowledge that you have read and understood our Privacy Policy. You can access it at https://zakazhi.io/ or by contacting zakazhi.support@gmail.com.
We do not sell your personal data. Payment card details are handled exclusively by PCI-DSS certified payment service providers and are never stored by Zakazhi.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the App or by email at least 14 days before the changes take effect. Continued use of the App after the revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the App.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of North Macedonia, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms or your use of the App that cannot be resolved through good-faith negotiation shall be subject to the exclusive jurisdiction of the competent courts of Shtip, North Macedonia.
If you are a consumer located in the European Union, you may also have access to alternative dispute resolution mechanisms available under EU consumer law.
